Valay Inc. (“Valay” or “we” or “us” or “our”) is committed to protecting your privacy. We have prepared this Privacy Policy to describe to you our practices regarding the Personal Data and Anonymous Data (as defined below) we collect from users (each, a “User” or “you” or “your”) of our mobile applications (each such application, an “Application”), widgets, websites, online services (“Services”), and technology platform (our Applications widgets, websites, Services, and technology platform, collectively, the “Valay Platform”). This Privacy Policy applies only to Personal Data and Anonymous Data collected on or through the Valay Platform, and does not apply to information collected or obtained by or through any other means (including information collected offline, in person, over the telephone, by mail, or from third parties outside the Valay Platform).

For purposes of this Privacy Policy, Users include (1) contractors, including contractor applicants (collectively, “Contractors”) and (2) Users who use the Valay Platform to request services from Contractors (“Customers,” and those services, “Contractor Services”).

If you have entered into a separate agreement regarding the Valay Platform, that separate agreement will prevail if it provides Valay with broader use and disclosure rights than this Privacy Policy. If you interact with the Valay Platform as both a Customer and a Contractor, certain portions of this Privacy Policy apply only to your interaction as a Customer and certain portions of this Privacy Policy apply only to your interaction as a Contractor.

2. User Consent.

By submitting Personal Data through the Valay Platform, you agree to the terms of this Privacy Policy and you expressly consent to the collection, use, and disclosure of your Personal Data in accordance with this Privacy Policy.

3. A Note About Children.

We do not intentionally gather Personal Data from Users who are under the age of 13. If a child under 13 submits Personal Data to Valay through the Valay Platform and we learn that the Personal Data is the information of a child under 13, we will attempt to delete the information as soon as possible. If you believe that we might have any Personal Data from a child under 13, please contact us at the address or phone number stated in section 1.

4. A Note to Users Outside of the United States.

If you are located outside the U.S., by visiting or using the Valay Platform and providing us with your Personal Data, you acknowledge and agree that your Personal Data may be processed (1) for the purposes identified in this Privacy Policy and (2) in the country in which it was collected and in other countries, including the United States, where laws regarding processing of Personal Data may be less stringent than the laws in your country. By providing your Personal Data, you consent to such transfer.

5. Types of Data We Collect. 

We collect Personal Data and Anonymous Data from and about Users of the Valay Platform. “Personal Data” means data that can be used by someone to identify or contact you, including, for example, your name, postal address, telephone number, and email address. “Anonymous Data” means all data collected from and about you other than Personal Data, including: (1) data that is about you but cannot, by itself, be used to identify you as an individual, and (2) data we create from Personal Data by excluding information (such as your name) that makes that data personally identifiable to you . We collect Personal Data and Anonymous Data on or through the Valay Platform, as further described below. This section 5 is intended to be illustrative, not exhaustive, and this Privacy Policy applies to all Personal Data and Anonymous Data collected by us in connection with your use of the Valay Platform.

(a) Information You Provide to Us.

We use the information we collect from all Users to:

• Account Registration Information. When you create an account on the Valay Platform (“Account”), we collect your first and last name, email address, mobile phone number, and password. If you decide to sign up for a Valay Account using your Facebook account, we will also collect basic information from your Facebook profile such as your name, gender, profile photo, and Facebook friends.

• User Profile Information. Creating an Account results in the creation of a Valay Platform profile (“Profile”) that contains the information you provide when you create an Account and other information you add to that Profile. Your name (and for Contractors, Profile photos) is always part of your Profile. If you are a Customer, to the extent permitted by the Valay Platform, you can also add a Business Profile to your Account, which requires that you provide a designated business email address and payment method.

• Contractor Application Information. If you decide to apply to join the Valay Platform as a Contractor, in addition to the basic Account registration information we collect your date of birth, physical address, Social Security Number, driver’s license information or other government-issued identification information, vehicle information, liability insurance information, and in some jurisdictions we may collect additional business license or permitting information.

• Contractor Payment Information. To make sure Contractors get paid, we collect information about Contractors’ bank routing and account numbers, tax information, and other payment information provided by Contractors.

• If you use the Valay Platform on your mobile device, including through one or more of our Applications, we may collect your phone number and the unique device ID number.

• When connecting to the Valay Platform via a service provider that uniquely identifies your mobile device, we may receive this identification and use it to offer extended services and/or functionality.

• Certain parts of the Valay Platform may require our collection of your phone number. We may associate that phone number to your mobile device identification information.

• When as a Customer you order Contractor Services on the Valay Platform, we will collect the information you provide as part of that order, such as a description and photographs of your requested Contractor Services.

• When as a Customer you order products or services (such as Contractor Services) on the Valay Platform, we will collect all information necessary to complete the transaction, including your name, credit card information, billing information and delivery information, the type of Contractor Services requested, date and time the Contractor Services were provided, amount charged, and other related transaction details. This information may be shared with third parties who will help process and fulfill your purchases. When you add a credit card or payment method to your Account, a non-Valay service provider that handles payments for us will receive your credit card or payment method information, as further described in section 10. To keep your financial data secure, we do not store full credit card or payment method information on our servers.

• If another User uses your referral or promotion code, we may associate your name with that User.

• When as a Contractor you respond to a Customer’s request for Contractor Services, we collect all information you submit in response to that request;

• We retain information on your behalf, such as files and messages that you store using your Account.

• If you provide us feedback or contact us via email, we will collect your name and email address, as well as any other content included in the email, in order to send you a reply.

• When you post content (text, images, photographs, messages, reviews, ratings, comments or any other kind of content that is not your email address) on the Valay Platform, the information contained in your posting, along with your name and Profile photograph, will be stored on our servers.

• We collect content you post while engaging in public activities on the Valay Platform. “Public activities” are any actions you take on blogs, forums, messages boards, and other areas of the Valay Platform that are designed to be visible to other Users of the Valay Platform, including posting comments, recommendations, reviews, and ratings.

• When you participate in one of our surveys, we may collect additional Profile information.

• We also collect other types of Personal Data that you provide to us voluntarily, such as your computing device operating system and version, product registration number, and other information you choose to provide if you contact us regarding support for the Valay Platform.

• If you participate in a sweepstakes, contest, or giveaway on the Valay Platform, we may ask you for your email address and/or home number (to notify you if you win or not). We may also ask for first and last names, and sometimes post office addresses to verify your identity. In some situations we may need additional information as a part of the entry process, such as a prize selection choice. These sweepstakes and contests are voluntary. We recommend that you read the rules for each sweepstakes and contest that you enter.

• We may also collect Personal Data on other parts of the Valay Platform that state that Personal Data is being collected.

(b) Information You Provide to Facebook and other Social Networking Sites (“SNSs”).

The Valay Platform allows Users to access Facebook to interact with friends and to share on Facebook, including through the Facebook Wall and friends’ News Feeds. If you are already logged into the Valay Platform and Facebook or another SNS, when you click on “Connect with Facebook,” or a similar connection on another SNS, you will be prompted to merge your profile on that SNS with your Valay Platform Profile. If you are already logged into the Valay Platform but not logged into Facebook or another SNS that we support, when you click on “Connect with Facebook,” or a similar connection on another SNS, you will be prompted to enter your SNS credentials or to “Sign Up” for the SNS. By proceeding, you are allowing the Valay Platform to access your information and you are agreeing to the Facebook or other SNS’ Terms of Use in connection with your use of the Valay Platform. Conversely, if you are not currently registered as a User of the Valay Platform, and you click on “Sign in” using Facebook or another SNS that we support, you will first be asked to enter your Facebook or SNS credentials and then be given the option to register for an Account on the Valay Platform. In this case, we may receive information from Facebook or another SNS to make it easier for you to create an Account on the Valay Platform and show our relevant content from your Facebook or SNS friends. Once you register for an Account on the Valay Platform and connect with Facebook or another SNS, you will be able to automatically post recent activity back to Facebook or the other SNS. Any information that we collect from your Facebook or other SNS account may depend on the privacy settings you have with that SNS, so please consult the SNS’s privacy and data practices.

(c) Information Collected via Technology.

• Information Collected by Our Servers. To help us understand how you use the Valay Platform and to help us make the Valay Platform more useful to you, our servers (which may be hosted by a non-Valay service provider) collect information from you, including your browser type, operating system, Internet Protocol (“IP”) address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session), domain name, and/or a date/time stamp for your visit.

• Log Files. As is true of most websites and mobile applications, the Valay Platform gathers certain information automatically and store it in log files. This information includes IP addresses, browser type, Internet service provider (“ISP”), referring/exit pages, operating system, date/time stamp, and clickstream data and other information about your interactions with the Valay Platform, including your actions within the Applications. We use this information to analyze trends, administer the Valay Platform, track Users’ movements around the Valay Platform, gather demographic information about our User base as a whole, and better tailor the Valay Platform to our Users’ needs. For example, some of the information may be collected so that when you visit or use the Valay Platform again, it will recognize you and the information could then be used to serve advertisements and other information appropriate to your interests. Except as noted in this Privacy Policy, we do not link this automatically-collected data to Personal Data.

• Cookies. Like many online services, the Valay Platform uses cookies to collect information. “Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing that website. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on the Valay Platform. This type of information is collected to make the Valay Platform more useful to you and to tailor your experience with us to meet your special interests and needs.

• How We Respond to Do Not Track Signals. We do not currently respond to “do not track” signals or other mechanisms that might enable Users to opt out of tracking on the Valay Platform.

• Flash LSOs. When we post videos, third parties may use local shared objects, known as “Flash Cookies,” to store your preferences for volume control or to personalize certain video features. Flash Cookies are different from browser Cookies because of the amount and type of data and how the data is stored. Cookie management tools provided by your browser will not remove Flash Cookies. • Mobile Services. We may also collect non-personal information from your mobile device if you have downloaded one or more of our Applications. This information is generally used to help us deliver the most relevant information to you. Examples of information that may be collected and used include your geographic location, how you use each Application, and information about the type of device you use. When as a Customer you use the Valay Platform to order Contractor Services: (1) we collect precise location data about the location for performance of those Contractor Services from the Valay application used by the Contractor; (2) if you permit our Application to access location services through the permission system used by your mobile device, we may also collect the precise location of your mobile device when the Application is running in the foreground or background; and (3) we may also derive your approximate location from your IP address. In addition, if one or more of our Applications crash on your mobile device, we will receive information about your mobile device model software version and device carrier, which allows us to identify and fix bugs and otherwise improve the performance of our Applications. This information is sent to us as aggregated information and is not traceable to any individual and cannot be used to identify an individual.

• Analytics Services and Interest-Based Advertising. In addition to the tracking technologies we place, other Persons may set their own cookies or similar tools when you visit the Valay Platform. This includes non-Valay analytics services, including Google Analytics (all such analytics services, “Analytics Services”), that we engage to help analyze how Users use the Valay Platform, as well as third parties that deliver content or offers. We may receive reports based on these parties’ use of these tools on an individual or aggregate basis. We use the information we get from Analytics Services only to improve the Valay Platform. The information generated by the Cookies or other technologies about your use of the Valay Platform (all such information, the “Analytics Information”) is transmitted to the Analytics Services. The Analytics Services use Analytics Information to compile reports on User activity. The Analytics Services may also transfer information to third parties where required to do so by law, or where such third parties process Analytics Information on their behalf. Each Analytics Services’ ability to use and share Analytics Information is restricted by such Analytics Services’ Terms of Use and Privacy Policy. By using the Valay Platform, you consent to the processing of data about you by Analytics Services in the manner and for the purposes stated above. We may also partner with advertising companies to support our marketing efforts, including by serving you advertisements better tailored to your likely interests. If you don’t want to take advantage of these services, you may be able to opt-out by visiting http://www.aboutads.info/ or http://networkadvertising.org/choices/, or if you are located in the EU, http://www.youronlinechoices.eu/.

• Call and Text Information. We may work with a non-Valay service provider to facilitate phone calls and text messages between Customers and Contractors who have been connected through the Valay Platform for Contractor Services, in which case we receive information about these communications including the date and time of the call or SMS message, the parties’ phone numbers, and the content of any SMS messages.

(d) Information Collected from You About Others.

If you decide to invite a third party to create an Account, we will collect your and the third party’s names and email addresses in order to send an email and follow up with the third party. We rely upon you to obtain whatever consents from the third party that may be required by law to allow us to access and upload the third party’s names and email addresses as required above. You or the third party may contact us at info[AT]valetfix.com to request the removal of this information from our database. As part of your use of the Valay Platform, we provide you the opportunity to connect automatically with your friends. We employ various techniques in order to facilitate friends finding each other on our service, including offering contact importer tools to facilitate adding to your contacts (including Facebook Friends and contacts in your address book) so that you can more readily ask your contacts to join and communicate with you through the Valay Platform. With your permission, we will access your address book, call log and SMS log, and import your contacts’ names, email addresses, phone numbers, image, geographic location and Facebook IDs to facilitate automatic connection with your friends. We do this only for contact matching to help your friends and you find each other. Also, when you invite friends to the Valay Platform, we will access your Address Book and we will import your contacts names and phone numbers in order to facilitate the invitation. The email that is sent to your friends will come from your email address so that your friends know that you want to invite them to visit the Valay Platform. We do not store any passwords you provide as part of the contact import process. We also collect some settings that help us to interpret your data, such as the language and keyboard settings that you have established, and the phone’s carrier, mobile network code and mobile country code.

(e) Information Collected from Third Parties.

We may receive Personal and/or Anonymous Data about you from third parties that provide one or more of our Services by way of a co-branded or private-labeled website or companies that offer their products and/or services on the Valay Platform. These third parties may supply us with Personal Data. We may add this information to the information we have already collected from you via the Valay Platform.

(f) Enterprise Solutions.

If your employer uses one of our enterprise solutions, such as Valay for Business, we may receive information about you from your employer.

​

(g) Customer and Contractor Ratings and Reviews.

When as a Customer you request Contractor Services, Contractors may provide us with a Customer rating and review after providing Contractor Services to you. When as a Contractor you provide Contractor Services, Customers may provide us with a Contractor rating and review after receiving Contractor Services from you. As further described in section 7(b), we provide Customers information about Contractors’ ratings and reviews and we provide Contractors information about Customers’ ratings and reviews.

(h) Background Information on Contractors.

Valay works with non-Valay service providers to perform background and registered sex offender checks on Contractors, and we receive information from these services providers such as publicly available information about a Contractor’s criminal history.

​

(i) Multiple Interactions.

If you interact with the Valay Platform in more than one capacity, for instance as a Contractor and as a Customer, we may combine or associate information we have collected from you in one capacity (for example, as a Contractor) with information we have collected from you in another capacity (for example, as a Customer).

​

(j) Location Information.

The Valay Platform’s main purpose is to connect Customers and Contractors. To do this, we need to know where you are. If you have enabled location services on your mobile device, when you open a Valay Application on that mobile device we collect information about your geographic location. We may also collect the precise geographic location of your device when an Application is running in the foreground or background. If you label certain locations, such as “home” and “work,” we receive that information, too. Your location information is necessary for things like matching Customers with nearby Contractors, determining locations for the performance of Contractor Services, and providing you with location-based information and advertising. Also, if the need ever arises, Valay may use and share location information to help protect the safety of Valay Users or a member of the public. If you give us permission through your mobile device settings or a Valay Application, we may collect your location information while that Application is off to, among other things, identify promotions or service updates in your area. If you do not want this location information collected by us, you can disable location services on your mobile device. Disabling a Valay Application’s collection of precise location information from your mobile device before or after you order Contractor Services will not limit our ability to collect your location information from a Contractor’s mobile device nor our ability to derive approximate location from your IP address. In addition, Customer and Contractor location is necessary for the provision of Contractor Services via the Valay Platform and without that location information we can’t provide Services to you.

6. Use of Your Personal Data.

​

(a) General Use.

In general, Personal Data you submit to us is used either to respond to requests that you make, or to aid us in serving you better. We may use your Personal Data in the following ways:

• facilitate the creation of and secure your Account on our network;

• identify you as a User in our system;

• provide improved administration of the Valay Platform;

• provide the Services you request;

• send or facilitate communications (1) between you and a Contractor, such as estimated times of arrival (ETAs), or (2) between you and a contact of yours at your direction in connection with your use of certain features, such as referrals;

• improve the quality of experience when you interact with the Valay Platform;

• send you a welcome email to verify ownership of the email address provided when your Account was created;

• send you administrative email notifications, such as security or support and maintenance advisories;

• respond to your inquiries related to employment opportunities or other requests;

• make telephone calls to you, on one or more occasions, as a part of secondary fraud protection or to solicit your feedback; and

• send newsletters, surveys, offers, and other promotional materials related to the Valay Platform and for other marketing purposes of Valay.

(b) User Testimonials and Other Feedback; Public Areas of Valay Platform.

We often receive testimonials and other feedback from Users about their experiences with the Valay Platform. We occasionally publish such content. When we publish this content, we may identify our Users by their first name and last initial and may also indicate their home city. Any information you post in your public activities, along with your screen name or ID, or any image or photo of you contained in your Profile, becomes publicly available to other Users and may be used by Valay for online and offline promotional or commercial uses in any and all media . If you choose to engage in public activities, you should be aware that any Personal Data you post can be read, collected, and used by other Users engaged in those public activities, and could be used to send you unsolicited messages and otherwise in a manner that violates this Privacy Policy, the law, or your personal privacy. We are not responsible or liable for the Personal Data you choose to post in the course of your public activities and we have no responsibility to publish, take down, remove, or edit any such Personal Data. Once you have posted information publicly, while you might be able to edit and delete it on the Valay Platform, you will not be able to edit or delete any of such information cached, collected, and stored elsewhere by others (for example, search engines).

(c) Contractor Information.

We use the information we collect from Contractors for the following purposes related to Contractor Services provided via the Valay Platform: (1) sending emails and text messages to Contractors who have started the contractor application process regarding the status of their application; (2) determining a Contractor’s eligibility to provide Contractor Services via the Valay Platform; (3) notifying Contractors about Contractor Services demand, pricing and service updates; and (4) calculating and providing Valay’s liability insurance policy and analyzing usage patterns for safety and insurance purposes.

(d) Creation and Use of Anonymous Data. We may create Anonymous Data from Personal Data by excluding information (such as your name) that makes the data personally identifiable to you. We may use Anonymous Data for any purpose and disclose Anonymous Data to third parties at our discretion.

​

(e) Call and Text Information. For security, fraud prevention, risk assessment, legal compliance, investigation, research and development, and customer support purposes, we may (1) review the contents of SMS messages sent through the Valay Platform, such as those between Customers and Contractors, and (2) monitor and/or record the contents of phone calls made through the Valay Platform, such as those between Customers and Contractors, in which case you will be given notice that your call may be recorded, and by proceeding you agree to allow Valay to monitor and/or record your call.

7. Disclosure of Your Personal Data.

We disclose your Personal Data as described in this section 7 and as described elsewhere in this Privacy Policy.

(a) Third Parties Designated by You.

When you use the Valay Platform, the Personal Data you provide will be shared with the third parties that you designate to receive such information, including other websites, your friends, relatives, and business associates. Depending on the type of access you grant to such third parties, they may also be permitted to edit the information you have provided to us and to designate others to access and edit such information. You may change your settings at any time as to who has access to your information by going to your Account settings and changing your publishing options.

(b) Sharing Between Customers and Contractors.

Customers and Contractors that have been matched (or selected for potential matching) for one or more Contractor Services are able to see basic information about each other, such as names, photographs, applicable Customer or Contractor ratings, and any information they have added to their Profiles. When a Customer requests Contractor Services, potential Contractors also see the location the Customer has provided for performance of the Contractor Services, the Customer’s average customer rating given by Contractors, and the information the Customer provides as part of the Customer’s Contractor Services order, such as a description and photographs of the requested Contractor Services (for example, if the requested Contractor Services involve repair of a leaky pipe, a description and one or more photographs of that leaky pipe). Customers may be provided the ability to see a Contractor’s vehicle information and real-time location as the Contractor approaches the Contractor Services location. Customers’ ratings of Contractors are shared with Contractors on a regular basis. We use commercially reasonable efforts to de-identify the ratings and feedback, but a Contractor might be able to independently discern the identity of the Customer that provided the rating or feedback. When you use the Valay Platform, we share your phone number and other contact information with your relevant Customer or Contractor to help you and your relevant Customer or Contractor communicate with each other to arrange Contractor Services. If you report a lost or found item to us, we will seek to connect you with the relevant Customer or Contractor, including sharing your contact information. We share your Personal Data with our insurance providers to help determine and provide relevant coverage in the event of an incident involving Contractor Services provided to or by you.

(c) Other Users.

We share your Personal data with other Valay Platform Users solely for the purpose of providing the Valay Platform. For example, if you signed up for a promotion with another User’s referral or promotion code, we share your Personal Data with that User to let that User know about your redemption of or qualification for that promotion.

(d) Your Employer.

We share your Personal Data with your employer (or similar entity) and any necessary third parties engaged by us or your employer (such as an expense management service provider) if you participate in any of our enterprise solutions such as Valay for Business. If you create a Business Profile (to the extent permitted by the Valay Platform), at the end of each Contractor Services project you will have the option to designate the project as a business project. If you do so, and your organization has an enterprise account with Valay, we may share information about your use of Valay Platform with your organization including Contractor Services details such as date, time, charges, and location of the Contractor Services. If you change organizations, it is your responsibility to update your Business Profile with the new information. (Please remember to check and set your designation settings accordingly.) If you integrate your Account with an expense platform (like Concur) we will share the Contractor Services details to your expense account.

(e) Non-Valay Service Providers.

We may share your Personal Data with non-Valay service providers to: provide you with the Services that we offer you through the Valay Platform; to conduct quality assurance testing; to facilitate creation of Accounts; to provide technical support; and/or to provide other services to Valay. For example, we share Contractors’ application and Profile information with non-Valay service providers to perform background and registered sex offender checks on Contractors to help protect Customers.

(f) Affiliates.

We may share your Personal Data with our parent company, subsidiaries, joint venturers, or other entities under common control with us (collectively, “Affiliates”), in which case we will require those Affiliates to comply with this Privacy Policy.

​

(g) Corporate Restructuring.

We may share your Personal Data in connection with or during negotiation of any merger, financing, acquisition or dissolution transaction, or proceeding involving the sale, transfer, divestiture, or disclosure of any part of our business or assets. In the event of our insolvency, bankruptcy, or receivership, Personal Data may also be transferred as a business asset. If a third party acquires our company, business, or assets, that third party will possess the Personal Data collected by us and will assume the rights and obligations regarding your Personal Data as described in this Privacy Policy.

(h) Social Networking Sites.

The Valay Platform may enable you to post content to SNSs (for example, Facebook or Twitter). If you choose to do this, we will provide information to those SNSs in accordance with your elections. You acknowledge and agree that you are solely responsible for your use of those SNSs and that it is your responsibility to review the terms of use and privacy policy of the provider of those SNSs. We are not responsible or liable for: (1) the availability or accuracy of any such SNSs; (2) the content, products, or services on or availability of any such SNSs; or (3) your use of any such SNSs.

(i) Disclosure to Third-Party Companies.

We may enter into agreements with third parties that provide the Valay Platform by way of a co-branded or private-labeled website or companies that offer their products and/or services on or through the Valay Platform (each such third party, a “Third-Party Company”). A Third-Party Company may want access to Personal Data that we collect from that Third-Party Company’s customers. As a result, we may disclose your Personal Data to a Third-Party Company; however, we will not disclose your Personal Data to any Third-Party Company for the Third-Party Company’s own direct marketing purposes, unless you have “opted-in” by following the instructions we provide to allow such disclosure. If you have opted-in to receive email communications from a Third-Party Company and later wish to discontinue receipt of these emails, you must contact the Third-Party Company directly to update your preferences. The privacy policies of these Third-Party Companies might apply to the use and disclosure of your Personal Data that we collect and disclose to those Third-Party Companies. Because we do not control the privacy practices of Third-Party Companies, you should read and understand their privacy policies.

(j) API and Integration Partners.

If you connect to the Valay Platform through an integration with a non-Valay service, we may share information about your use of the Valay Platform with that third party.

(k) Other Disclosures.

Regardless of any choices you make regarding your Personal Data (as described in section 9 below), Valay may disclose Personal Data if we otherwise notify you and you consent to the sharing, or if Valay believes in good faith that such disclosure is necessary (1) in connection with any legal investigation; (2) to comply with applicable laws or to respond to subpoenas or warrants served on Valay; (3) to protect or defend the rights or property of Valay or Users of the Valay Platform; and/or (4) to investigate or assist in preventing any violation or potential violation of law, this Privacy Policy, or any agreement between us and you (including our Terms of Service Agreement).

(8) Non-Valay Websites.

The Valay Platform may contain links to non-Valay websites. When you click on a link to any non-Valay website, you will leave the Valay Platform and go to that non-Valay website, and a third party may collect Personal Data or Anonymous Data from you. We have no control over, do not review, and are not responsible or liable for, these non-Valay websites or their content. Please be aware that the terms of this Privacy Policy do not apply to these non-Valay websites or their content, or to any collection of your Personal Data after you click on links to any such non-Valay websites. We encourage you to read the privacy policies of every website you visit. The links to non-Valay websites are provided merely as a convenience and do not signify or imply our endorsement of, or association with, the owners or operators of those non-Valay websites or their products, services, content, or websites. You use any such links and the products, services, and content accessed thereby at your own discretion and at your own risk.

(9) Your Choices Regarding Information.

You have several choices regarding the use of information on the Valay Platform:

(a) Email Communications.

We will periodically send you free newsletters and emails that directly promote the use of the Valay Platform. When you receive newsletters or promotional communications from us, you may indicate a preference to stop receiving further commercial or promotional communications from us and you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the email you receive or by contacting us directly (please see our contact information in section 1). Despite your indicated email preferences, we may send you transactional and relational communications about your Account and use of Valay Services and other parts of the Valay Platform, including notices of any updates to our Terms of Service Agreement or Privacy Policy.

(b) Cookies.

If you decide at any time that you no longer wish to accept Cookies from the Valay Platform for any of the purposes described above, then you can instruct your browser, by changing its settings, to stop accepting Cookies or to prompt you before accepting a Cookie from the websites you visit. Consult your browser’s technical information. If you do not accept Cookies, however, you may not be able to use all parts and functionality of the Valay Platform. (c) De-Linking SNS.

You may manage the sharing of certain Personal Data with us when you connect with us through an SNS, such as through Facebook Connect. Please refer to the privacy settings of the applicable SNS to determine how you may adjust our permissions and manage the interactivity between the Valay Platform and your SNS account or mobile device.

(d) Changing Your Personal Data.

You may review, update, or correct the Personal Data in your Account (including any imported contacts) by editing your Profile via the Valay Platform (with respect to that portion of your Profile that is self-editable) or by emailing info[AT]valetfix.com with the Subject Line: “Change Profile Information.” We will use commercially reasonable efforts to comply with your request. We may retain an archived copy of your records as required by law or for legitimate business purposes.

(e) Applications.

You can stop all collection of information by an Application by uninstalling that Application. You may use the standard uninstall processes available as part of your mobile device or via the applicable mobile application marketplace or network.

(f) Push Notifications.

You can opt out of receiving push notifications through your mobile device settings. Please note that opting out of receiving push notifications might impact your use of the Valay Platform (such as receiving a notification that your Contractor has arrived).

(10) Security of Your Personal Data.  

• For online payments and/or Automated Clearing House (ACH) payouts, we use the payment services of Stripe (https://stripe.com/). We do not process, record, or maintain your credit card or bank account information. For more information on how payments are handled, or to understand the data security and privacy afforded such information, please refer to https://stripe.com/us/privacy.

• Valay is committed to protecting the security of your Personal Data. We use a variety of industry-standard security technologies and procedures designed to help protect your Personal Data from unauthorized access, use, or disclosure. We also require you to enter a password to access your Account information. Please do not disclose your Account password to unauthorized people. No method of transmission over the internet, or method of electronic storage, is 100% secure, however. Therefore, while Valay uses reasonable efforts to protect your Personal Data, Valay cannot guarantee its absolute security.

(11) Changes to This Privacy Policy.

This Privacy Policy may be updated on one or more occasions for any reason. We will notify you of any changes to this Privacy Policy by posting the new Privacy Policy here: http://www.Valetfix.com/privacy-policy and we will change the “Last Revised” date above. We may supplement any such notices by notifying you through one or more other means, such as email or through the Valay Platform. You should consult this Privacy Policy regularly for any changes.
